Understanding the Role of Your HOA Management Company

One of the most common misunderstandings about HOA management is the difference between the management company and the people or entity that actually govern the Association.

Southern Coast Properties provides professional management and administrative services to the communities we manage.

We are not the governing body of the HOA.

Who Makes the Decisions?

That depends on the stage of the community.

Communities Under Declarant Control

In communities that are still in the development or construction phase and remain under Declarant control, the Declarant makes decisions reserved to the Declarant under the Association's governing documents and applicable law.

Southern Coast Properties may be responsible for communicating or administering those decisions, but that does not necessarily mean we made them.

Communities Under Homeowner Control

After a community transitions to homeowner control, the HOA Board of Directors makes decisions reserved to the Association and Board under the governing documents and applicable law.

Southern Coast Properties works for the Association and helps the Board administer those decisions.

What Does Southern Coast Properties Do?

Depending upon our management agreement with the Association, our responsibilities may include:

• Communicating with homeowners
• Maintaining Association records
• Processing payments
• Coordinating vendors
• Obtaining proposals
• Assisting with compliance matters
• Sending notices and correspondence
• Carrying out authorized Board or Declarant decisions
• Providing administrative support to the Association

Because our office frequently sends the email, letter, notice, invoice, or other communication, we often become the face of the decision.

But the person communicating a decision and the person or entity with authority to make that decision are not necessarily the same.

If you disagree with an assessment, compliance matter, architectural decision, expenditure, maintenance decision, community policy, or another Association matter, Southern Coast Properties can help communicate your concern through the appropriate process.

However, we cannot independently override a decision that belongs to the Declarant or HOA Board.

Our Commitment

Our responsibility is to professionally administer the community within the authority provided to us, maintain appropriate records, communicate clearly, coordinate services, and carry out authorized decisions.

Homeowners have responsibilities.

Board members have responsibilities.

Declarants have responsibilities.

Vendors have responsibilities.

And Southern Coast Properties has responsibilities.

Good community management works best when everyone understands which role belongs to whom.

We don't replace your Declarant or HOA Board. We help them manage the community.
